Terms of Service

Effective Date: January 1, 2026

These Terms of Service (“Terms”) govern your access to and use of the websites and services operated by jchowlabs, LLC (“jchowlabs,” “Company,” “we,” “us,” or “our”), including:

(collectively, the “Sites”), including all content, features, interactive content, voice agent, and scheduling functionality made available through the Sites.

By accessing or using the Sites, you agree to these Terms. The voice agent requires one additional step: on your first visit, a consent notice asks you to review and accept both these Terms and our Privacy Policy before the agent is available. If you decline, you may still read the Sites but the voice agent will not load. The limitation of liability and dispute resolution provisions in Sections 8 and 14 take full effect upon that affirmative acceptance.

1. About jchowlabs

jchowlabs, LLC is a California single-member limited liability company that operates two related sites:

jchowlabs.com – a personal portfolio website with insights articles and interactive labs.
jchowlabs.chat – a managed services provider that builds and manages AI voice agents on small business websites and telephone systems.

The voice agents on our Sites are operational tools. On jchowlabs.com, the agent answers questions about site content and can navigate you to relevant insights articles or interactive labs. On jchowlabs.chat, the agent answers questions about our services, can navigate you to a relevant section of the site, and can facilitate appointment bookings with our team. Managed services engagements are governed by a separate written agreement and are not formed merely by using the Sites.

Client production sites that we build or operate under a managed services engagement are not covered by these Terms. Those sites are governed by the client’s own terms of service and privacy policy, and our role on them is governed by the separate written agreement between jchowlabs and the client.

2. Eligibility

You must be at least 18 years of age to access or use the Sites.

By using the Sites, you represent and warrant that:

You are at least 18 years old
You have the legal capacity to enter into a binding agreement
Your use of the Sites complies with all laws and regulations applicable in your jurisdiction

We reserve the right to terminate access for any user we have reason to believe does not meet these requirements.

3. Services Available Through the Sites

A. Informational Content

The Sites provide articles, research, writeups, and educational content related to AI, identity security, voice technology, and managed AI voice services. This content is provided for general informational and educational purposes only and does not constitute professional, legal, security, financial, or technical advice. Reading our content does not create a professional relationship between you and jchowlabs.

B. Interactive Security and Identity Content

The jchowlabs.com site hosts interactive demonstrations of identity, authentication, and security concepts — currently including WebAuthn / passkey authentication, camera-based facial liveness detection, and browser fingerprint inspection. All of these run entirely within your browser. No image, video, biometric, or fingerprint data is transmitted to our servers or to any third-party service, and none is stored. When you navigate away or close the tab, all locally processed data is discarded. See our Privacy Policy for details.

These demonstrations:

Are educational in nature and may be modified, suspended, or discontinued at any time without notice
Are not intended to simulate or replace production security systems
Should not be used to process sensitive personal, financial, or confidential information

C. AI Voice Agent

The Sites include an AI-powered voice agent. On jchowlabs.com, the agent answers questions about site content and can navigate you to relevant insights articles or interactive labs — it does not collect contact information and does not schedule appointments. On jchowlabs.chat, the agent answers questions about our services, can navigate you to a relevant section of the site, and can schedule consultation appointments with our team. The voice agent is an automated tool powered by AI.

AI disclosure. At the start of every voice session — whether via website or telephone — the agent announces that it is an AI assistant. Example: “Hi, I’m the AI assistant for jchowlabs. How can I help you today?” The voice agent is not a human representative.

Use of the voice agent is opt-in and requires the affirmative acceptance described in the opening of these Terms. The voice agent:

Does not constitute professional advice of any kind
Is not designed to handle medical, legal, financial, or other sensitive decisions
Should not be relied upon for those purposes

D. Scheduling and Booking

jchowlabs.chat includes appointment scheduling functionality through the voice agent and our calendar integration. Booking a consultation does not by itself create a professional engagement between you and jchowlabs. Any resulting engagement will be governed by a separate written agreement.

4. Managed Services Engagements

If you engage jchowlabs for managed services (for example, to build, deploy, or operate a website or voice agent for your business), any such engagement will be governed by a separate written agreement — typically a Master Services Agreement, a Statement of Work, and, where personal information is processed on your behalf, a Data Processing Addendum. Those documents — not these Terms — govern the engagement, the scope of services, the allocation of privacy and security responsibilities, the handling of your data or your customers’ data, and the commercial and liability terms between us.

These Terms govern your use of the Sites themselves. Nothing in these Terms modifies, replaces, or supplements the terms of a separate engagement agreement between you and jchowlabs.

5. Prohibited Conduct

These rules exist because voice agents can be misused in many ways — impersonation, data harvesting, adversarial probing. The core principle is simple: use the Sites honestly, legally, and for their intended purposes.

By using the Sites, you agree that you will not:

General

Use the Sites for any unlawful purpose or in violation of any applicable law or regulation
Impersonate any person or entity or misrepresent your affiliation with any person or entity
Submit any content that is harmful, threatening, abusive, defamatory, or otherwise objectionable through the voice agent or any other feature
Interfere with or disrupt the operation of the Sites or any connected infrastructure
Attempt to gain unauthorized access to any account, system, or data
Attempt to circumvent any security measure or abuse protection on the Sites

Voice Agent

Attempt to probe, scan, exploit, or test the vulnerability of the Sites, voice agent, or any connected infrastructure without our express written authorization
Use automated scripts, bots, crawlers, or similar tools to interact with the voice agent, except for well-behaved search engine crawlers operating consistent with our robots.txt
Use the voice agent to attempt to extract confidential information, manipulate underlying models or prompts, or bypass safety measures
Use the voice agent to transmit harassing, abusive, or unlawful content
Use the voice agent architecture or implementation for any commercial purpose — including reproducing its design or configuration for deployment in a commercial product or service — without our express written consent

We reserve the right to determine, in our sole discretion, what constitutes a violation of these Terms.

6. Intellectual Property

All original written content, articles, research, and branding on the Sites — including the jchowlabs name, logo, and site identity — are the intellectual property of jchowlabs, LLC and are protected by applicable copyright and trademark law.

You are granted a limited, non-exclusive, non-transferable license to access and use the Sites for their intended informational purposes. This license does not include the right to reproduce, distribute, or create derivative works from the Sites’ original content without our express written permission.

What you may not do. Unless you have our express written permission, you may not:

Reproduce, republish, or redistribute original written content, articles, or research materials from the Sites
Use the jchowlabs name, branding, or marks in any way that implies endorsement or affiliation with jchowlabs

DMCA / Copyright Complaints

If you believe content on the Sites infringes your copyright, please send a written notice to privacy@jchowlabs.com with the subject line “DMCA Notice” that includes:

Identification of the copyrighted work you claim has been infringed
Identification of the material on the Sites that you claim is infringing, with enough detail for us to locate it (for example, a URL)
Your contact information (name, address, telephone number, email)
A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf
Your physical or electronic signature

We will respond to properly submitted notices consistent with the Digital Millennium Copyright Act.

7. Disclaimer of Warranties

In plain English: The Sites and voice agent are provided as-is. We can’t guarantee they’ll always be available or error-free. Nothing the voice agent says is professional advice — don’t rely on it for medical, legal, financial, or other sensitive decisions.

THE SITES, CONTENT, AND VOICE AGENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JCHOWLABS, LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
WARRANTIES THAT THE SITES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS
WARRANTIES AS TO THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT OR VOICE AGENT RESPONSE

The voice agent is an automated AI tool. No output from any voice session should be interpreted as a professional recommendation, security assessment, or professional advice of any kind.

8. Limitation of Liability

In plain English: Our financial liability to you is capped at $500 or the amount you’ve paid us in the past year, whichever is higher. We’re not responsible for indirect losses like lost profits or lost data.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

JCHOWLABS, LLC, ITS MEMBERS, OFFICERS, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES arising out of or related to your use of or inability to use the Sites, including but not limited to loss of data, unauthorized access to your data by third parties, or reliance on any content or voice agent response.

IN NO EVENT SHALL JCHOWLABS, LLC’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITES EXCEED THE GREATER OF (A) FIVE HUNDRED DOLLARS ($500) OR (B) THE AMOUNT YOU HAVE PAID TO JCHOWLABS, LLC IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, regardless of the form of action or the basis of the claim.

These limitations apply whether or not jchowlabs, LLC has been advised of the possibility of such damages, and to the maximum extent permitted by law. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Nothing in this section limits our liability for fraud, willful misconduct, gross negligence, or any other liability that cannot be limited as a matter of applicable law.

This Section 8 governs only your use of the Sites. Liability arising out of a managed services engagement is separately governed by the written agreement entered into for that engagement and is not subject to the cap in this Section.

9. Indemnification

You agree to indemnify, defend, and hold harmless jchowlabs, LLC and its members, officers, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

Your use of the Sites or voice agent
Your violation of these Terms
Your violation of any applicable law or regulation
Any content you submit through the voice agent or scheduling system

10. Access Termination and Suspension

We reserve the right to suspend or terminate your access to the Sites or voice agent, with or without notice, if we reasonably believe you have:

Violated these Terms
Engaged in conduct that poses a security risk to the Sites, infrastructure, or other users
Attempted unauthorized access to systems or data
Used the voice agent in a manner that violates Section 5 (Prohibited Conduct) or poses a security or integrity risk to the Sites

Where practical and where doing so does not compromise security or the integrity of an investigation, we will attempt to notify you of a termination or suspension. We are not obligated to provide notice before acting when a security risk is present. Termination of your access does not affect any rights or obligations that arose before termination, including our data obligations under the Privacy Policy.

11. Third-Party Services

The Sites integrate with third-party service providers including:

ElevenLabs — voice agent processing (text-to-speech, speech-to-text, conversational AI) for website and telephone agents
Vapi — voice agent processing (text-to-speech, speech-to-text, conversational AI) for website and telephone agents
Twilio — telephone number provisioning and telephony services for the jchowlabs.chat phone agent
Google — large language model for conversational AI responses
OpenAI — large language model for specific agent configurations
Cal.com — calendar booking and appointment scheduling (jchowlabs.chat only)
GitHub — static site hosting
Cloudflare — content delivery, edge routing, and abuse prevention
Stripe — invoice generation and payment processing (customer portal only — not used in general Site interactions)

Your interactions with these services may be subject to their own terms and privacy policies, in addition to our Privacy Policy. We are not responsible for the practices, content, or availability of any third-party service. Links to third-party sites or services do not constitute our endorsement of those sites or services.

12. Accessibility

We are committed to making the Sites usable by the broadest possible audience, including individuals with disabilities. If you encounter an accessibility barrier or need content provided in an alternative format, please contact privacy@jchowlabs.com and we will make reasonable efforts to address the issue or provide an accessible alternative.

13. Changes to These Terms

We may update these Terms periodically. Updates will be posted with a revised effective date. For non-material changes, continued use of the Sites following the updated effective date constitutes your acceptance of the revised Terms. For material changes — including changes to the limitation of liability, prohibited conduct, or dispute resolution provisions — we will provide reasonable advance notice. Where required by applicable law, we will seek fresh consent before material changes take effect.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

A. Informal Resolution First

Before initiating any arbitration or legal proceeding, you agree to contact us at privacy@jchowlabs.com with a written description of your dispute and the relief you seek, and give us 30 days to attempt to resolve it informally. This requirement does not apply if you are seeking emergency injunctive relief. We agree to the same obligation before initiating any claim against you.

B. Binding Arbitration

If a dispute cannot be resolved informally, you and jchowlabs, LLC agree to resolve it through final and binding arbitration rather than in court, except as provided in Section 14C below.

Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, available at www.adr.org. The arbitration will be conducted in California, or by telephone or video at either party’s election. The arbitrator shall apply California law. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

This arbitration agreement is mutual. jchowlabs, LLC also agrees to resolve disputes with you through arbitration rather than court, on the same terms.

For claims under $10,000, you may choose whether the arbitration proceeds by telephone, video, written submissions, or in person. For claims under $25,000, AAA’s Expedited Procedures apply. Your share of arbitration fees will not exceed $200 for consumer claims under AAA’s Consumer Arbitration Rules. We will cover any remaining AAA administrative fees.

C. Small Claims Court Carve-Out

Either party may bring an individual claim in small claims court in California instead of arbitration, provided the claim qualifies for small claims court and remains an individual claim.

D. Class Action Waiver

YOU AND JCHOWLABS, LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

The arbitrator may not consolidate more than one person’s claims and may not preside over any class or representative proceeding. If this class action waiver is found unenforceable for any reason, the entire arbitration agreement in Section 14B shall be null and void, and the dispute shall be resolved in court under Section 14E.

E. Courts for Non-Arbitrable Claims

For any claim that is not subject to arbitration under these Terms — including disputes about the validity or scope of the arbitration agreement itself — you consent to the exclusive jurisdiction of the state and federal courts located in California.

15. Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce that provision in the future.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and jchowlabs, LLC regarding your use of the Sites, and supersede any prior agreements or understandings on that subject. Where you have entered into a separate written agreement with jchowlabs for managed services, that agreement governs your engagement and controls over these Terms to the extent of any conflict.
